Radius Alpha – Terms of Service

These Alpha Terms (the “Terms”) govern access to Radius (“The Product”), an experimental, pre-release AI model gateway and agent service layer hosted and provided by Earendil Works Co. (“Earendil,” “we,” “us” or “our”). Radius provides access to multiple AI models, budget controls and token-usage visibility using Radius-supplied inference or customer-supplied provider keys (“BYOK”). Other alpha features may be added. By creating an account, purchasing credits, enabling automatic top-up or using Radius, you agree to these Terms. You must be at least 18 to use Radius. If you use Radius for an organization, you represent that you have authority to bind it.

1. Acceptable use

Radius is offered for development, testing and evaluation. It may contain errors and may be changed, interrupted or discontinued at any time. Do not use or rely on Radius for production workloads, customer-facing operations other than tests with designated users, safety-critical functions or purposes requiring accuracy, availability, security or continuity. No service-level, support, capacity, continued-access or launch commitment applies.

You may use Radius directly, through compatible tools or agents, or in applications for designated test users. You are solely responsible for your account, integrations, test users and legal compliance.

You must not use Radius to violate the law or others’ rights; facilitate harm or abuse; distribute malware; bypass safety, security or rate controls; or resell access or credits.

You should not include personal, sensitive or regulated data, confidential data, or live credentials or secrets in session content or artifacts.

2. Customer Content and privacy

You retain your rights in material you submit (“Customer Content”). You grant Earendil a limited license to receive, process, transmit and, when you intentionally use a storage feature, store Customer Content as needed to provide Radius, including through third-party providers. You represent that you have the rights and permissions needed to submit Customer Content and use it with Radius. Earendil and its licensors retain all rights in Radius.

Our Privacy Notice explains how we handle personal data in connection with Radius. By using Radius, you acknowledge that you have read the Privacy Notice. These Terms are not a data processing agreement.

3. Credits and access

Credits may be purchased or granted without charge. Prices and rates may change prospectively. Credits have no cash value, may not be transferred or resold, and are non-refundable except as required by law or stated here. Promotional credits may expire or be withdrawn. Automatic top-up authorizes charges at your selected amount and threshold until disabled.

Earendil may limit, suspend or terminate access, models, routes or features at any time. If Earendil permanently ends Radius or terminates you for reasons unrelated to breach, misuse or non-payment, your sole remedy is a refund of unused purchased credits.

4. Outputs, disclaimers, liability and indemnity

Outputs are experimental and may be inaccurate, incomplete, insecure or harmful. You are solely responsible for reviewing them and for any code, decision, application or action based on them. As between you and Earendil, Earendil assigns to you any rights it owns in an Output. Outputs may not be unique and may be subject to third-party rights.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RADIUS, OUTPUTS AND RELATED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. EARENDIL DOES NOT WARRANT ACCURACY, AVAILABILITY, SECURITY, UNINTERRUPTED OPERATION OR ANY PROVIDER, MODEL, OUTPUT OR SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EARENDIL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, BUSINESS INTERRUPTION, DATA CORRUPTION OR SUBSTITUTE SERVICES. EARENDIL’S TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR RADIUS CREDITS DURING THE 30 DAYS BEFORE THE EVENT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR AFFECTS MANDATORY RIGHTS AVAILABLE TO CONSUMERS.

To the extent permitted by law, you will defend, indemnify and hold harmless Earendil, its affiliates, personnel and licensors from third-party claims and reasonable costs arising from your applications, test users, Customer Content, unlawful use or material breach of these Terms, except to the extent caused by Earendil’s violation of law.

5. General

Earendil may update these Terms prospectively and will post or communicate material changes; continued use after the effective date constitutes acceptance. Delaware law and courts apply, subject to mandatory consumer protections in your country of residence. Invalid provisions will be limited without affecting the remainder. These Terms are the entire agreement regarding Radius alpha testing. If you provide feedback, Earendil may use it without restriction or obligation. Contact feedback@earendil.com.
